Debt Settlement through Debt Negotiation

Debt Settlement through Debt Negotiation is another option for the many American consumers that are struggling with severe credit card debt or considering bankruptcy. Based on information provided by Max Bruck, a Board at Large Member of The Association of Settlement Companies (TASC), a debt settlement agency attempts to negotiate with your creditors to settle your debt for less than what is currently owed. Keep in mind that there are no assurances that each or any of your creditors will reduce your debt. Plus, if you stop making payments to your creditors at any time even after entering a debt settlement program, the late fees and interest are often still added to your debt each month. Likewise, your creditors may also file a lawsuit against you which could lead to wage garnishments if a judgment is entered in the creditor′s favor prior to a settlement being reached with the creditor. By not making payments, your credit rating will also be negatively affected. According to a report by the National Economic Research Institute (available upon request), "Whatever the effect of the debt negotiation program on an individual′s credit score, it was likely to produce a better ultimate credit rating than would a declaration of bankruptcy. Similarly, an organized credit negotiation program may provide a better ultimate credit rating than an individual would have with a slow slide into non-payment."

Once accepted into a debt settlement program, consumers generally make payments to both the Debt Settlement Company and into an independently managed savings account. The Debt Settlement Company is supposed to leverage your savings to negotiate with your creditors. The Debt Settlement Company should also present you with settlement offers from your creditors, but it should ultimately remain your decision whether or not to accept each individual offer. With your written approval, the Debt Settlement Company can then use your saved funds to pay off your debt in lump-sum payments over the course of the program.
